Welcome to Buffyz.

These Terms & Conditions (“Terms”) govern your access to and use of the Buffyz website, application and related services (“Platform”).

By accessing, browsing or using Buffyz, you agree to these Terms. If you do not agree with these Terms, please do not use the Platform.

1. About Buffyz

Buffyz is a service and manpower aggregation and connection platform.

Buffyz enables customers to submit requirements for services, workers and manpower and enables workers, professionals, service providers and businesses to submit their availability or interest in work.

Buffyz may facilitate communication, introductions, enquiries, quotations, scheduling and coordination between users.

Buffyz is not necessarily the employer, contractor, owner, manufacturer or direct service provider of every person or business introduced through the Platform.

Unless expressly stated otherwise in writing, the actual service or work engagement is between the customer and the relevant worker, professional, agency, business or service provider.

2. How the Platform Works

A typical request may work as follows:

A customer submits a requirement.
Buffyz reviews or receives the requirement.
Relevant information may be shared with an appropriate worker or service provider.
Buffyz may contact the customer or service provider.
The parties may discuss the work, price, timing and other conditions.
The parties decide whether to proceed.
The agreed work is performed by the relevant service provider or worker.

Submission of a request does not guarantee that a worker will be available or that a service will be provided.

3. Independent Service Providers

Workers and service providers connected through Buffyz may be independent individuals, contractors, professionals, agencies, businesses or other third parties.

Unless specifically stated otherwise:

They are not employees of Buffyz.
Buffyz does not guarantee their qualifications, experience or professional status.
Buffyz does not control how independent service providers perform their work.
Buffyz does not guarantee their availability.
Buffyz does not guarantee completion of a particular job.
Buffyz does not guarantee the quality, suitability, safety or legality of third-party services.

Users are responsible for making appropriate enquiries before entering into an engagement.

4. Customer Responsibility

Customers are responsible for:

Providing accurate information about the required work.
Providing a safe and lawful working environment.
Clearly communicating the scope of work.
Confirming prices and payment terms before work begins.
Providing necessary access, materials or information where applicable.
Paying the agreed amount to the relevant service provider.
Following applicable laws and safety requirements.

Customers must not use Buffyz to request unlawful, dangerous or prohibited services.

5. Worker / Service Provider Responsibility

Workers and service providers are responsible for:

Providing accurate information about their identity, skills and experience.
Performing accepted work professionally and lawfully.
Agreeing the scope and price before beginning work.
Following applicable laws and safety requirements.
Maintaining any licence, registration, qualification or authorization legally required for their work.
Communicating honestly with customers.

Workers and service providers must not use Buffyz to engage in fraud, harassment, unlawful activities or conduct that may harm customers or other users.

6. Pricing and Payment

Unless otherwise expressly stated by Buffyz, Buffyz does not determine the final price of work performed by an independent service provider.

The final price may depend on:

Nature of work
Labour requirements
Materials
Duration
Distance
Urgency
Project size
Other requirements agreed between the parties

The customer and service provider should confirm the price and scope of work before work starts.

Where Buffyz charges a booking fee, commission or other fee, the applicable amount and terms will be communicated separately.

7. No Guarantee of Availability

Submitting a booking or enquiry does not guarantee:

Availability of a worker
Acceptance of the job
A particular completion time
A particular price
Successful completion of the requested service

Buffyz may attempt to identify or connect an appropriate service provider but cannot guarantee that a suitable provider will always be available.

8. Third-Party Services

Services are often performed by third parties.

Accordingly, to the extent permitted by applicable law, Buffyz is not responsible for independent third-party acts or omissions, including:

Delay
Poor workmanship
Failure to attend
Cancellation
Damage to property
Theft
Misrepresentation
Personal injury
Disputes over payment
Disputes concerning employment
Failure to complete work
Quality or suitability of work

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

9. Verification

Buffyz may perform reasonable checks on workers or service providers where feasible.

However, verification may be limited and should not be interpreted as a guarantee, certification, employment relationship or warranty of the provider’s conduct or performance.

Users should conduct their own verification where the nature of the work requires additional qualifications, licences, identity checks, background checks or other due diligence.

10. Employment and Manpower Requests

Buffyz may connect businesses or individuals seeking workers with workers seeking employment or assignments.

Buffyz does not automatically become the employer of a worker merely because the worker was introduced through Buffyz.

The parties must independently determine the applicable employment, contractual, salary, working-hour, statutory-benefit, tax, labour-law and other obligations.

Where Buffyz itself becomes a contracting employer or service provider under a separate written agreement, that separate agreement will govern the relevant relationship.

11. User Information

Users must provide truthful, accurate and current information.

You must not:

Impersonate another person.
Submit false information.
Create fraudulent requests.
Misuse another person’s contact information.
Attempt to obtain services through deception.
Use the Platform for unlawful activities.
Harass, threaten or abuse another user.
Circumvent reasonable Platform safeguards.

Buffyz may suspend or restrict access where misuse is reasonably suspected.

12. Communication Between Users

By submitting a service or job request, you acknowledge that Buffyz may contact you by telephone, SMS, WhatsApp, email or other reasonable communication methods regarding your request.

Where necessary to facilitate the requested service or job, Buffyz may provide relevant contact or requirement information to the other party.

Users are responsible for their communications and agreements with each other.

13. User Disputes

If a dispute occurs between a customer and a worker/service provider, the parties should first attempt to resolve the matter directly.

Buffyz may, at its discretion, assist with communication or coordination.

However, unless Buffyz is itself a contractual party to the relevant transaction, Buffyz is not responsible for resolving the underlying contractual dispute.

Nothing in this section prevents a person from exercising any legal right or remedy available under applicable law.

14. Prohibited Activities

Users must not use Buffyz for:

Illegal activities
Fraud or scams
Money laundering
Threats or harassment
Human trafficking or exploitation
Activities involving prohibited goods or services
Unauthorized financial transactions
Any activity violating applicable law
Any activity that could reasonably harm Buffyz, its users or third parties

Buffyz may refuse or remove requests that appear unlawful, unsafe or inappropriate.

15. Content Submitted by Users

Users may submit descriptions, photographs, documents, reviews or other information.

You represent that you have the right to submit such material and that it does not knowingly violate applicable law or another person’s rights.

You grant Buffyz a limited right to use submitted information as reasonably necessary to operate the Platform, facilitate the requested service, communicate with users, resolve disputes and improve the Platform, subject to our Privacy Policy.

16. Reviews and Feedback

Users may be invited to provide feedback or reviews.

Reviews should be truthful and based on genuine experience.

Buffyz may remove content that is unlawful, fraudulent, abusive, defamatory, threatening, irrelevant or otherwise inappropriate, subject to applicable law.

17. Intellectual Property

The Buffyz name, logo, website design, software, text, graphics, trademarks and other Platform materials may belong to Buffyz or its licensors.

Users may not copy, reproduce, modify, distribute, sell or commercially exploit Platform content without appropriate authorization.

18. Website Availability

We aim to keep Buffyz available and functional, but we do not guarantee uninterrupted or error-free operation.

The Platform may occasionally be unavailable because of:

Maintenance
Technical problems
Internet or telecommunications failures
Third-party service failures
Security incidents
Circumstances beyond our reasonable control

19. Disclaimer

The Platform is provided to facilitate connections between customers and workers/service providers.

Except where expressly stated otherwise, Buffyz does not provide a warranty that:

A particular worker will accept a request.
A particular service provider will be available.
A service will meet a particular expectation.
A third party will perform work to a particular standard.
Information provided by a third party is complete or accurate.
A service will be completed within a particular time.

Users should independently evaluate whether a service provider is appropriate for their specific requirements.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Buffyz shall not be responsible for indirect, incidental, special, consequential or purely economic losses arising from interactions or transactions between users and independent third parties.

This may include losses arising from:

Failure of a third party to perform work
Delay or cancellation
Disputes between users
Third-party misconduct
Property damage caused by an independent provider
Loss resulting from information supplied by a third party

However, nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

21. Indemnification

To the extent permitted by law, a user may be responsible for losses, claims, liabilities, costs or expenses arising from the user’s:

Breach of these Terms;
Fraudulent or unlawful conduct;
Misuse of the Platform;
Violation of another person’s rights; or
False or misleading information supplied by the user.

This provision does not remove or limit any rights available to a consumer under applicable law.

22. Privacy

Use of personal information is governed by the Buffyz Privacy Policy.

By submitting information through Buffyz, you acknowledge that relevant information may need to be shared with workers, service providers, employers or customers in order to facilitate the requested service or job.

23. Changes to the Platform

Buffyz may add, remove, modify or discontinue features, services or parts of the Platform from time to time.

We may also update these Terms when reasonably necessary.

The updated Terms will be posted on this page with a revised “Last Updated” date.

24. Governing Law and Jurisdiction

These Terms shall be governed by the laws applicable in India.

Subject to any mandatory rights or jurisdiction available to consumers or other persons under applicable law, disputes concerning Buffyz and these Terms shall be subject to the jurisdiction of the competent courts having jurisdiction over Motihari, East Champaran, Bihar, India.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the extent necessary, and the remaining provisions shall continue to apply to the extent permitted by law.

26. No Waiver

Failure by Buffyz to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

27. Entire Agreement

These Terms, together with the Privacy Policy and any specific written agreement applicable to a particular service, constitute the terms governing use of the Platform, subject to applicable law.
